Terms & Conditions

These Terms and Conditions ("Terms") form a binding agreement between Domato AI Pty Ltd (ABN 94 695 794 346) ("we", "us", "our") and you ("you", "your") in relation to your access to and use of the Public IQ website, application and related services at publiciq.domato.ai (the "Service").

By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. About the Service

Public IQ aggregates publicly-available Australian datasets — including ABS Census, ABS SEIFA, ACARA school data, state Valuer-General sales registers, state rental bond data, state crime statistics, GTFS public-transport data and OpenStreetMap amenities — and presents them in one interface per Australian suburb. We do not generate the underlying data; we curate, join and present it.

2. Important — research only, not advice

The Service provides general information only. Nothing on Public IQ is financial, investment, legal, tax, mortgage, real-estate or property advice.

We are not a licensed financial adviser, real-estate agent, conveyancer, lender or tax agent. The data on a suburb profile — including median price, yield, demographics, SEIFA, school ICSEA, crime rate, capacity-calculator outputs and Public IQ Score — is indicative, comes from third-party sources, may contain errors or omissions, and may be out of date. Before making any decision based on what you see here, you should obtain professional advice and verify critical numbers against the originating source.

3. Eligibility and accounts

  • You must be at least 16 years old to use the Service. If under 18, you must have permission from a parent or guardian.
  • You may use most of the Service anonymously. Some features (cross-device sync, private notes, account preferences) require an account.
  • You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Tell us immediately at support@domato.ai if you suspect unauthorised access.
  • We may suspend or terminate accounts that breach these Terms.

4. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose, or in any way that could damage, disable or impair the Service;
  • scrape, copy, download, mirror or systematically harvest data from the Service beyond what a normal browsing session requires (you may use the export buttons we provide for your own non-commercial purposes);
  • resell, sub-license, white-label or commercially exploit any part of the Service or its presentation, design, code or branding without our written permission;
  • attempt to gain unauthorised access to any user account, server, database or part of the Service;
  • introduce viruses, malware or other harmful code; or
  • misrepresent the source, accuracy or freshness of data obtained from the Service.

5. Intellectual property

  • The Service itself — the user interface, code, design, logos, copy, methodology (including the Public IQ Score and the smart-badge engine) — is owned by us or our licensors and is protected by Australian and international copyright law.
  • Underlying data — most data displayed comes from open-government sources under Creative Commons Attribution 4.0 International (CC BY 4.0) or equivalent licences. Each suburb profile cites its sources. You may use this data in accordance with the originating agency's licence.
  • Your content — when you save private suburb notes, you retain ownership of those notes. You grant us a limited, non-exclusive licence to store, display and back them up for the purpose of operating the Service. We do not use your private notes to train AI models.

6. Lead capture and brokeriq referrals

Public IQ is operated by Domato AI Pty Ltd, which also operates brokeriq — a free service that matches Australian home buyers with local mortgage brokers. We disclose the following so you can make an informed choice:

  • When you click a brokeriq referral link from Public IQ, we pass through limited context (the suburb you were viewing, your indicative deposit and income from your saved profile if you're signed in, watchlist size). You can review this before submitting on brokeriq.
  • If a mortgage broker matched through brokeriq settles a loan with you, the broker pays brokeriq a referral fee. You pay nothing.
  • We do not include sponsored suburbs in any rankings, list, score or default sort. Where a result is influenced by a third party in any way, we will say so explicitly inline.
  • If you give us your email through any of the optional capture forms (newsletter, "email me this report", capacity scenario, professional contact), we will only use it for the stated purpose plus, if you have ticked the consent box, the weekly suburb-pulse newsletter. See our Privacy Policy.

7. Third-party links and data

The Service includes outbound links to third-party sites (the source agencies, Google Maps, Apple Maps, OpenStreetMap, brokeriq, and others). We are not responsible for the content, accuracy, privacy practices or availability of any third-party site. Your use of those sites is governed by their own terms.

8. Availability

We aim to keep the Service available, but we do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, upgrades, third-party-provider outages or circumstances outside our reasonable control. We will not be liable for any loss arising from any unavailability.

9. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer rights you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot lawfully be excluded.

If a service we provide to you is subject to a non-excludable consumer guarantee, our liability for failing to comply with that guarantee is limited (where permitted) to, at our option, supplying the services again or paying the cost of having the services supplied again.

10. Disclaimer and limitation of liability

Subject to clause 9, the Service is provided "as is" and "as available". To the maximum extent permitted by law:

  • we make no warranties or representations about the accuracy, currency, completeness, reliability or fitness for purpose of any data or content on the Service;
  • we exclude all implied warranties, conditions and guarantees;
  • we are not liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for loss of profit, loss of revenue, loss of business, loss of goodwill or loss of data, however caused, arising out of or in connection with your use of (or inability to use) the Service or any decision made in reliance on it; and
  • our total aggregate liability to you for all claims arising under or in connection with these Terms is limited to AUD $100 or, if greater, the amount you have paid us in the 12 months preceding the event giving rise to the claim.

11. Indemnity

You agree to indemnify us against all claims, losses, damages, costs and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your violation of any law, or your infringement of any third-party right.

12. Privacy

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.

13. Changes to these Terms

We may update these Terms from time to time. The version date at the top of this page reflects the latest change. We will notify account-holders of any material change. By continuing to use the Service after a change, you accept the updated Terms.

14. Termination

You may stop using the Service at any time. If you have an account, you can delete it by emailing support@domato.aifrom the account's email address. We may suspend or terminate your access to the Service at any time if you breach these Terms or for any other reasonable cause. Sections that by their nature should survive termination (intellectual property, disclaimer, limitation of liability, indemnity, governing law) will survive.

15. Governing law and jurisdiction

These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia.
